The US Supreme Court has unanimously dismissed an unsubstantiated Texas lawsuit seeking to overturn the result of the presidential election in what is the biggest blow to Donald Trump’s attack on democracy.
In a brief, one-sided order, all nine judges in the American Supreme Court opposed protracted efforts to remove the number of votes the president had lost in four states: Georgia, Michigan, Pennsylvania, and Wisconsin.
The decision puts another nail in the coffin of Trump’s increasingly desperate efforts to undermine the will of the people and deny Joe Biden the presidency.
The lawsuit brought by Texas Attorney General Ken Paxton aimed to invalidate the results in four swing states and asked the court to extend the election certification deadline so that alleged voting irregularities could be investigated.
It was backed by Donald Trump, 17 other states, and 126 Republicans in the House of Representatives – more than half the caucus – including House Minority Leader Kevin McCarthy of California and the minority whip, Steve Scalise of Louisiana.
Trump had long voiced hope that a controversial election would take place in the Supreme Court, to which he appointed three judges during his tenure to ensure a 6-3 Conservative majority. On the previous Friday he tweeted: « If the Supreme Court shows great wisdom and courage, the American people will win what is perhaps the most important case in history and our electoral process will be respected again! »
But hours later, his hopes for a political miracle were all but extinguished. The Supreme Court wrote: “The Texas state application for permission to file a notice of appeal is denied for lack of standing under Article III of the Constitution. Texas has shown no judicial interest in the way another state conducts its elections. All other pending requests are dismissed as in dispute. ”
Officials in Michigan, Pennsylvania, Georgia and Wisconsin had ridiculed the suit as a publicity stunt. More than 20 other attorneys general from states such as California and Virginia also filed a brief Thursday asking the court to dismiss the case.
Josh Shapiro, the Pennsylvania attorney general, welcomed the court’s decision. « Our nation’s supreme court has seen through this seditious abuse of our electoral process, » he tweeted. “This swift denial should make anyone considering further attacks on our election think twice. ”
Democrats in Congress also expressed gratitude. California’s Eric Swalwell tweeted, “The Supreme Court, a mix of conservative and liberal members, has come together to defend your vote against @realDonaldTrump and its democracy deniers in Congress. ”
And Senator Ben Sasse, one of the relatively few Republicans to recognize Biden’s victory, signaled that it was time for the party and government to move on. He said: “Since election night, a lot of people have confused voters by doing the Kenyan birther guy. “Chavez carved the election out of the grave conspiracy theories, but any rule of law American should take comfort that the Supreme Court – including all three of President Trump’s recommendations – closed the book on the nonsense. ”
Courts have dismissed numerous lawsuits and appeals from the Trump campaign and its allies in various states. William Barr, the attorney general and a staunch ally of Trump, said the Justice Department had found no evidence of widespread electoral fraud that could alter the election result.
Saturday marks the 20th anniversary of. Times the court that won the 2000 elections in favor of Republican George W. Bush decided. However, this was a much tighter competition that boiled down to one state: Florida. Biden received 306 votes on the electoral college – just like Trump in 2016 – and leads the national referendum with 7 million.
Some Democrats have accused Trump and his Republican supporters of rioting. Chris Murphy, Senator for Connecticut, said in a speech on Friday: “Those who push for Donald Trump to be named president for a second term, regardless of the election result, are implicated in treason against their nation. ”
