Peel Regional Police Officers will not face criminal charges in connection with the death of a 34-year-old man in Mississauga in 2019, SIU says.

According to the SIU report, two officers involved in the situation refused to submit their observations and refused to be given the last interview. SIU says both officers acted within their rights.

The report says so in September. On September 10, 2019, officers were called to a home on Morning Star Drive in Malton to respond to reports of family disorder.. A man in the house called the police because his brother was acting erratically.

The police said the man said it was « a bad situation » and that his brother had been suffering from psychological problems for the past five days. SIU says police attended his mother’s house the previous Sunday for similar cases with the man’s brother. The report says that the recipient heard « a loud and angry shouting and banging in the background. ».

The report says that another resident also called 911, and told the worker that her sons were fighting..

Two officers were sent home before the 911 call and arrived while the mother was reporting the fight. According to SIU, an officer entered, believing an active fight was taking place at home, with CEW.

The report says that the two brothers rushed from the basement and told the officer that he had been assaulted by the other.. The SIU says the officer who drew CEW asked the two men to sit on opposite sides of the room and that while one complied, the other was still agitated and would not sit still.

SIU says the man got up and « stopped his arms shouting at [the officer] not to use CEW with him. ». At this time, a resident called the other officer, who was locked outside, inside. His CEW has also been withdrawn.

The report says the agitated man seemed to be calming down, so First Officer blocked CEW.

SIU says that shortly after taking up his weapon, the agitated man ran across the room and the officer thought « he was pouncing on him in an aggressive and rampant state. ». «  The officer posted CEW twice to the man to no avail, and the man pulled the CEW wires and continued running towards the front door, shouting and slapping his arms.

The report says that another officer caught the man near the front door and they ran into difficulty before the second officer intervened to help his partner. The report says that the man beat one officer and that, due to the proximity and difficulty controlling the man, his CEW officer posted. Once again, CEW appeared to have no effect, and the man reportedly opened the front door and the conflict spilled over into the entrance corridor..

The report says that the officers, who eventually managed to defeat the man and arrest him, called the paramedics, as an incision from CEW was placed in the man’s body. The report says the other man in the house told the officers that his brother may have consumed cocaine and alcohol that day.

According to an officer, he turned the man to his left side to make sure he was not having difficulty breathing.

The report states that another officer who arrived at the scene reported seeing the man repeatedly screaming for his (deceased) father and seeing him roll while lying on his forehead with his hands tied behind his back. The report states that the officers told the man that they would help him sit down, but he did not stop the beating, and remained on his stomach, and the two officers grabbed him as a result.. .

The report stated that the man’s words became inspiring and difficult to understand and that the officers tried to bring him back to his side because he appeared to be having difficulty breathing. The report says officers kept talking to him and calling to find out when the ambulance would arrive, citing concerns that the EMS was taking too long to arrive..

The paramedics arrived and found the man was « suppressed, making an incomprehensible noise. ». While being placed in the ambulance, he was in medical distress and lost all vital signs. Paramedics tried to resuscitate him and he was transferred to Etobicoke General Hospital, where he was pronounced dead upon arrival.

The report says that an autopsy pathologist attributed the cause of death to triggering delirium (cocaine and ethanol toxicity) during self-control..

“The post-mortem report concluded that the cumulative effects of confusion, conflict, and posture with impaired respiratory movements and cocaine may have all contributed to causing sudden cardiac arrest.. It is possible that the CIA did not play a major role, if any, in his death. « .

Joseph Martineau, Director of SIU, writes that “There are no reasonable grounds to believe that either of the two aforementioned officers has committed a criminal offense in connection with the death of the man.

Martineau said that although he was alarmed by the evidence that the man had been held on the ground for a period of time before the paramedics arrived, he did not believe that the officers’ behavior was a reckless disregard for the man’s life or safety..

In the report, Martineau said officers told him they tried to transport the man to more ideal locations while waiting for the EMS to arrive, but his agitation made it difficult. However, Martineau said some evidence indicated that officers did not put him on his side as they said, because he was lying on his stomach when paramedics arrived at the scene.. .

“As the pathologist concluded in the autopsy, the fact that [the man] was handcuffed behind his back and in a prone position“ likely ”played a role in his death if he lost consciousness before turning against him and not being restrained. If unconsciousness began after the handcuffs were removed and rolled over, their role, albeit less obvious, « may have » also « contributed to the death of the complainant, » he wrote.

“In the final analysis, it remains unclear with regard to the evidence whether the role of restraints and the position of the subduction caused or contributed to the death of [the man] and to what extent. Whatever the case, while the subordinate officers may behave unreasonably in placing [the man] in the prone position for any period of time given his highly emotional state at the time, I am unable to reasonably conclude that the officers are reckless, weighing the totality of evidence, It made their behavior a noticeable and significant departure from a reasonable standard of care in these circumstances.

Describing the man’s death as a tragedy, Martineau wrote that “there is not enough evidence” to reasonably conclude that the level of force used was lawful or that the level of care exercised by the officers was substandard to warrant criminal charges.
