We’ve come to the end of political debate season and while no one really wants to have to watch any of these other things, the alternative is the Giants and the Eagles, so what are you going to do? Besides, who is Trump not going to deny this time? We’ve already had him defend white supremacists and QAnon… North Korea? Russia? New Coke?

As always, we’ve compiled a drinking game to make the evening’s festivities a little easier to organize for legal professionals. There shouldn’t be a lot of opportunities to chat about the courts tonight, but if previous versions of this game are any indication, don’t plan on going to work tomorrow.

« Supreme Court »: The topics, we are told, will be: the fight against Covid-19, American families, race in America, climate change, national security and leadership Given that the Judicial Committee Senate just voted to rewrite decades of precedent and the former vice president delivered the final coup de grace of bureaucratic court reform, it’s hard to believe the court will not appear in one form or another But not landing on the approved topics list suggests we could avoid a real overdose of mentions

Any Supreme Court Case: But… man… if families end up talking about Obergefell and Roe, and climate change starts talking about EPA cases, and leaders turn to the ACA Also cancel your Saturday plans

Judicial superlatives (see instructions): Whether a judge or the courts themselves, one sip for each letter in the attached superlative Example: « Our great Supreme Court » is five sips « The formidable Amy Coney Barrett »10 Sips » The 7th Anti-Disestablishmentarian Circuit « gives you the option to quit the game for your own safety

Chevron (ask an expert nearby how much they think you should drink): None of these guys are enough in the weeds to get into this during climate negotiations, are they?

« Court-Packing »: Much like the « fake news », this one started as a rallying cry from the left and turned into a Republican attack. Maybe this is « leadership »?

« Court Expansion » (don’t drink, just watch your beer and know you really should take a sip): Can Joe Biden make it go fetch?

Voting Rights Act: This is one of the most important topics under the general title of Race in America and something that makes Amy Coney Barrett’s confirmation particularly terrifying

Bork (drink until you think it’s the ’80s again): If both supporters come back to Biden vs. Bork, it’s a red letter day for legal nerds

Hunter Biden: The above exception is whenever Trump strayed from the real topic to try to say something about Hunter Biden, child pornography, Burisma, or deals with Chinese companies

MUTE: sip whenever the mute button is called This one could go either way I could see this was a big deal, but I could also imagine this to be a lot more tamer based on the aftermath of the last debate

Named Specific Pharmaceutical Verified: He Must Talk About COVID And Will He Brag About Regeneron Treatment? Remdesivir? Hydroxychloroquine? Lysol? The spice blend?

Michael Flynn: No debate about national security or leadership would be complete without pointing out that the administration’s first national security adviser has pleaded guilty and is awaiting sentencing

False crimes: whenever a candidate agrees to use the DOJ to « get to the bottom » of a possible crime, such as Borat « criminally » deceiving Rudy or Benghazi

John Durham (finish your drink): Russiagate’s Ultimate Nullifier fundamentally failed at this point, but its eventual reveal has survived as an article of faith among conspiracy theorists

Jeffrey Toobin (jump on Zoom and finish your drink): Is there a reason to talk about this? No. Can I credibly imagine hearing Trump trying to link Biden to « liberals » like « Creepy Toobin »? Yes

Amendments (see description): Shots corresponding to amendment number when mentioned In other words, one shot for the first amendment, two shots for the second amendment, etc. So far we have avoided the twenty-fifth but Trump has had COVID since, so who knows
